LEGAL AND SECURITY
First And ForemostWhatever you do, don't post any information that you want to keep confidential. In
these cases, it is highly recommended that you secure an NDA before proceeding
to relay such information to other people.
Legal ConsiderationsPlease use this site carefully. You may have signed confidentiality agreements
and they should be honored, so make sure you own what you post. This means
that you may have to scrub your submissions of covered information. Now, there
are some gray areas as there always are in such things.
For example, one issue would be how to describe your idea or concept knowing
that you cannot outright state information that is confidential. If the challenge
description asks for a device that actuates at the freezing point of water, then
clearly you cannot say that the challenge asked for this. However, if you simply
post an idea and one of its functions or important features is that it actuates
at 0C and you simply state this without referencing the challenge requirements
or description, then you may be good.
Please bear in mind that openOI is not an attorney and this is only their personal
view on such things. You need to think for yourself, review any agreements you
have signed, do some research and, if necessary, seek a proper legal opinion.
We also hope that you will share your experiences on this sort of thing.
Sometimes, this sort of stuff may need to be tested with a fun lawsuit or a friendly
game of legal fortitude. While this site's administration will always suspend and/or
remove material that is found to be in clear violation of a current non-disclosure
agreement, they are also willing to push back if it seems like the right thing to do.
Another legal consideration has to do with posting inventions that have not had
a patent application filed on them. One advantage here is that posting here may
be viewed as a public display and this may prevent others from patenting the idea
for themselves after the publication (post) date. The main disadvantage is that
once an invention is displayed in public, the inventor may only have one year
to file on it or it becomes public domain. A two edged sword not doubt, but
such displays can be a very useful tool in certain situations.
Again, this should not be taken as a valid legal opinion as it is only a lay person's
analysis and understanding of the current patent environment. You should do your
own thinking, research and, if needed, get advice from an attorney or registered
patent agent before posting inventions here.
The Wild, Wild WebIt should go without saying that you should also always be careful in dealing
with people that you do not know on this site. Please contact the site admins
if you meet anyone suspicious or whatever. It also recommended that you scan
any files downloaded from this site. Again, please report viruses or anything
else unusual to site administration.
